Potintia, Inc. (dba HowDo) (“HowDo”) respects your privacy and is committed to protecting it through this Privacy Policy.

This Privacy Policy describes the types of information we may collect when you visit our website at www.howdo.com, including any content, functionality and services offered on or through www.howdo.com (the “Site”), whether as a guest or a registered user, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Policy applies to information we collect on the Site and in email, text, or other electronic messages between you and the Site.

Please read this Privacy Policy carefully before you start to use the Site to understand our policies and practices regarding your information and how we will treat it. By using the Site or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by this Privacy Policy. If you are not willing to agree to this Privacy Policy, you must not access or use the Site. 

Children Under The Age Of 13

IN NO EVENT MAY YOU ACCESS OR USE THE SITE IF YOU ARE UNDER THE AGE OF 13.

The Site is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Site. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Site or on or through any of the features of the Site, register on the Site, use any of the interactive or public comment features of the Site or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use.

Information We Collect About You and How We Collect It

When you access the Site, HowDo will collect certain information about you, including the following:

Information You Provide To Us. The Site provides various opportunities for users to provide information. We collect information that users provide by filling out forms on the Site, communicating with us via contact forms, responding to surveys, search queries on our search feature, providing comments or other feedback, interactions via social media, SMS and messaging and providing information when ordering a product or service via the Site. 

We use information you provide to us to deliver the requested product and/or service, to improve our overall performance, and to provide you with offers, promotions, and information we think will be relevant and useful to you.

Information We Collect Through Automatic Data Collection Technology. As you navigate through the Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns. This will generally include information about your browsing pattern through the Site and any communications between your computer and the Site.  Among other things, we will collect data about the type of computer you use, your Internet connection, your IP address, your operating system, and your browser type.

We use Google Analytics to help us understand your use of the Site and the popularity of certain content so we can improve your experience. Use of Cookies And Pixels

Similar to other websites, our website utilizes a standard technology called “cookies” and server logs to collect information about how the Site is used. Information gathered through cookies and server logs may include the date and time of visits, the pages viewed, time spent at the Site, and the websites visited just before and just after our own, as well as your IP address.

A cookie is a very small text document, which often includes an anonymous unique identifier. When you visit a website, that site’s server asks your computer for permission to store this file in a part of your hard drive specifically designated for cookies. Each website can send its own cookie to your browser if your browser’s preferences allow it, but (to protect your privacy) your browser only permits a website to access the cookies it has already sent to you, not the cookies sent to you by other sites.

HowDo may use technological equivalents of cookies, including social media pixels. These pixels allow social media sites to track visitors to outside websites in order to tailor advertising messages users see while visiting that social media website. HowDo may use these pixels in compliance with the policies of the various social media sites.​

Retention of Information

We retain the information that we collect about you for as long as reasonably necessary for the purposes set out in this Privacy Policy. We also may retain your information for a longer period of time on the basis of our legitimate interests in providing or marketing our services to you or as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Even if we delete some or all of your information, we may continue to retain and use information that has been aggregated or anonymized so that it can no longer be used for personal identification.

Email Policies

We are committed to keeping your email address confidential. We do not sell, rent, or lease our subscription lists to third parties, and will not disclose your email address to any third parties except as allowed in the section below titled Disclosure of Your Information.

In compliance with the CAN-SPAM Act, all emails sent from our organization will clearly state who the email is from and provide clear information on how to contact the sender. In addition, all email messages will contain concise information on how to remove yourself from our mailing list so that you receive no further email communication from us.
Users who no longer wish to receive our newsletter or promotional materials may opt-out of receiving these communications by clicking on the unsubscribe link in the email.

Why We Collect Information

HowDo collects your information in order to record and support your participation in the activities you select on the Site. If you register to download a training module or other resource, sign up for our newsletter, and/or subscribe to receive a product from us, we collect your information. We use this information to track your preferences and to keep you informed about the products and services you have selected to receive and any related products and/or services. As a visitor to the Site, you can engage in most activities without providing any personal information. It is only when you seek to download resources and/or register for services that you may be required to provide information.

If you are outside the European Union and opt to receive any free resources, participate in any free training programs, register for a webinar, register for a live event, register for a seminar, or purchase any products sold by HowDo on the Site, we will automatically enroll ​you to receive our free email newsletter. If you do not wish to receive this newsletter, you can unsubscribe anytime. We include an “unsubscribe” link at the bottom of every email we send. If you ever have trouble unsubscribing, you can send an email to do@howdo.com requesting to unsubscribe from future emails.

If you are in the European Union and opt to receive any free resources, participate in any free training programs, register for a webinar, register for a live event, register for a seminar, or purchase any products sold by HowDo on the Site, we will only enroll ​you to receive our free email newsletter if you affirmatively consent to it. How Do We Use the Information That You Provide to Us? 

We use personal information for purposes of presenting the Site and its contents to you, providing you with information, providing you with offers for products and services, providing you with information about your subscriptions and products, carrying out any contract between you and HowDo, administering our business activities, providing customer service, and making available other items and services to our customers and prospective customers.
From time to time, we may use the information you provide to us to display advertisements to you that are tailored to your personal characteristics, interests, and activities.

Disclosure Of Your Information

We do not sell, rent, or lease any information collected from you, whether collected automatically or voluntarily provided by you.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose your personal information:

  • To our subsidiaries, affiliates, and service providers for the purpose of providing our services to you. 
  • To a third party, including a lawyer or collection agency, when necessary to enforce our terms of service or any other agreement between you and HowDo.
  • To any successor in interest in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of HowDo’s asserts and/or business.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of HowDo, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

How Do We Protect Your Information and Secure Information Transmissions? 

We have implemented commercially reasonable measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. These measures include using standard security protocols and working only with reputable third-party vendors.

Any information you enter on the Site will be transmitted securely via a secure medium known as Secure Sockets Layer, or SSL. Credit Card information and other sensitive information is never transmitted via email.

To help maintain the security of the Site and to ensure that the Site remains available to all users, HowDo uses software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Your California Privacy Rights

California law grants additional privacy rights to California residents. In particular, the California Consumer Privacy Act (CCPA) requires businesses to disclose, for the past 12 months, (i) the categories of personal information collected, (ii) the sources of the collected personal information, (iii) the purposes for which the collected personal information is used, (iv) the categories of personal information disclosed for a business purpose, and (v) the categories of any personal information sold. HowDo provides these disclosures in the following table. (Note that HowDo does not sell any personal information, even under the broad CCPA definition of a “sale.”)

Right to access/know your information. You may request from us a list of (i) the personal information that we have collected about you, and (ii) the categories of third parties to whom we have disclosed your personal information. You have the right to up to two (2) access requests each twelve (12) months.

Right to delete your information. You may request, at any time, that we delete your information and direct our service providers to delete your information from their records.

You may contact us to exercise these rights at do@howdo.com. To ensure the privacy and protection of individuals, we are required to verify your identity (or that of your authorized agent) or otherwise authenticate your request(s), which we will do in accordance with the CCPA regulations. Please note that, under the CCPA, we are not required to grant a request to access/know or a request to delete with respect to personal information obtained from you in your role as an employee, owner, director, officer or contractor of a company and within the context of HowDo providing its services to such company.

Other State Privacy Rights

Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Data portability.
  • Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

Your European Privacy Rights 

If you are a resident of the European Union, you are entitled to certain information and have certain rights under the General Data Protection Regulation (Regulation (EU) 2016/679) (the “GDPR”). Those rights include:

  • The right of access to your information.
  • The right to rectify your information if it is incorrect or incomplete.
  • The right to have your information erased (“right to be forgotten”) if certain grounds are met.
  • The right to withdraw your consent to our processing of your information at any time (if our processing is based on consent).
  • The right to object to our processing of your information (if processing is based on legitimate interests).
  • The right to object to our processing of your information for direct marketing purposes.
  • The right to receive your information from us in a structured, commonly used and machine-readable format, and the right to transmit your information to another controller without hindrance from us (data portability).

If you are located in the European Union and you are or have been a user of our services, we may send you marketing communications based on our legitimate interests, subject always to your right to opt out of such communications. Further, if you are located in the European Union, we will never share your information with a third party for such third party’s marketing purposes, unless you have specifically consented to us doing so.

You may contact us at do@howdo.com to exercise any of the above rights. We may request specific information from you to confirm your identity, and in some circumstances, we may charge a reasonable fee for access to your information.

Furthermore, if you believe that our processing of your information is inconsistent with your data protection rights under the GDPR and we have not adequately addressed your concerns, you have the right to lodge a complaint with the data protection supervisory authority of your country.

For purposes of the GDPR, we are a “controller” and you are a “data subject.”

Visitors Outside the United States

HowDo is a U.S.-based company. If you are a non-U.S. resident and provide us with your personal information, you acknowledge and agree that your personal information may be transferred to and processed in the United States, where the laws regarding processing of personal information may be less stringent than the laws in your country. By providing your information, you consent to such transfer and processing.

Privacy Policy Changes

We will post any changes we make to this Privacy Policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the email address specified in your account and/or through a notice on the Site home page. The date this Privacy Policy was last revised is identified at the top of this Privacy Policy. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting the Site and this Privacy Policy to check for any changes.
